Welcome to ZAYA Fundraising. These Terms and Conditions (“Terms”) apply to your use of the ZAYA Fundraising platform, including our website and any related services. By accessing or using the platform, you agree to these Terms and enter into a legally binding agreement with ZAYA Fundraising (“ZAYA,” “we,” “us,” or “our”).By creating an account or using the platform, you confirm that you have read, understood, and agreed to these Terms.

1. Overview of Services ZAYA Fundraising provides a platform that allows individuals, teams, and organizations to create and manage fundraising campaigns by offering products for sale. A portion of each purchase supports the designated fundraiser or beneficiary. ZAYA operates solely as a technology platform that facilitates fundraising activities. We do not act as a bank, payment processor, charity, or financial advisor.

2. Key Roles Organizer – The individual responsible for setting up and managing a fundraiser Seller/Participant – Individuals who promote and share the fundraiser Buyer – Customers who purchase products in support of a fundraiser Beneficiary – The organization or cause receiving funds

3. How ZAYA Fundraising Works Organizers create a fundraising campaign through the platform Participants share personalized links or pages to promote the fundraiser Buyers purchase products directly through the platform A percentage of each purchase is allocated to the fundraiser ZAYA provides the tools and infrastructure to support these campaigns but does not guarantee fundraising results.

4. Payments & Payouts ZAYA uses third-party payment processors to securely handle transactions Funds are collected and distributed according to the fundraiser structure Organizers are responsible for ensuring funds are used as described Payout timelines may vary depending on processing and verification requirements

5. User Responsibilities By using ZAYA Fundraising, you agree to: Provide accurate and truthful information Use funds only for the stated fundraising purpose Comply with all applicable laws and regulations Maintain the confidentiality of participant and customer data Avoid misleading, fraudulent, or prohibited fundraising activities

6. Prohibited Activities Users may not use the platform to: Conduct illegal or deceptive fundraising Promote harmful, offensive, or prohibited content Sell unauthorized or unrelated products Engage in fraudulent financial activity ZAYA reserves the right to suspend or terminate accounts that violate these rules.

7. Platform Role & Limitations ZAYA Fundraising: Does not endorse any specific fundraiser or cause Is not responsible for how funds are ultimately used Does not guarantee fundraising success May suspend or modify services at any time

8. Data & Communication By using the platform, you consent to receiving communications related to your account, fundraiser, and activity. ZAYA may use third-party tools to support operations, including customer service and payment processing.

9. Intellectual Property All platform content, branding, and materials are owned by ZAYA Fundraising or its licensors. Users may not copy or distribute content without permission.

10. Dispute Resolution Any disputes related to the platform may be resolved through binding arbitration, as permitted by applicable law.

11. Changes to Terms ZAYA may update these Terms at any time. Continued use of the platform indicates acceptance of any updates.
